Democratizing Constitutional Law: Perspectives on Legal Theory and the Legitimacy of Constitutionalism.Thomas Bustamante & Bernardo Gonçalves Fernandes (eds.) - 2016 - Cham: Imprint: Springer.
This volume critically discusses the relationship between democracy and constitutionalism. It does so with a view to respond to objections raised by legal and political philosophers who are sceptical of judicial review based on the assumption that judicial review is an undemocratic institution. The book builds on earlier literature on the moral justification of the authority of constitutional courts, and on the current attempts to develop a system on "weak judicial review". Although different in their approach, the chapters all focus (...)

  2. A Marca do Cognitivo e Cognição 4E.Bernardo Gonçalves Alonso & Ronaldo de Oliveira Ramos - 2022 - Princípios: Revista de Filosofia (Ufrn) 29 (58):24-48.
In this article it is defended that the notion known as “The mark of the cognitive” is better characterized as a process that performs the function of generating intelligent behavior, in a flexible and adaptive way, capable of adapting to circumstances, given it is a context sensitive process. For that, some relevant definitions of cognition are examined. In the end, it is pointed out that the definition of the mark of cognition as a context-sensitive process takes into account several factors (...)

In this article I defend that Floridi’s Theory of Strongly Semantic Information – TSSI – is correct while encompassing the Veracity Thesis, which guides the semantic information definition as “p is information if and only if p is constituted by meaningful, truth well-formed data”. I argue that the theory is not arbitrary because it deals with important philosophical conundrums, mainly by avoiding the Bar-Hillel and Carnap paradox (1953) generated from the classical theory of semantic information. First, one of the classic (...)

  4. Can machines think? The controversy that led to the Turing test.Bernardo Gonçalves - 2023 - AI and Society 38 (6):2499-2509.
Turing’s much debated test has turned 70 and is still fairly controversial. His 1950 paper is seen as a complex and multilayered text, and key questions about it remain largely unanswered. Why did Turing select learning from experience as the best approach to achieve machine intelligence? Why did he spend several years working with chess playing as a task to illustrate and test for machine intelligence only to trade it out for conversational question-answering in 1950? Why did Turing refer to (...)

    The Turing Test is a Thought Experiment.Bernardo Gonçalves - 2023 - Minds and Machines 33 (1):1-31.
The Turing test has been studied and run as a controlled experiment and found to be underspecified and poorly designed. On the other hand, it has been defended and still attracts interest as a test for true artificial intelligence (AI). Scientists and philosophers regret the test’s current status, acknowledging that the situation is at odds with the intellectual standards of Turing’s works. This article refers to this as the Turing Test Dilemma, following the observation that the test has been under (...)

Irony with a Point: Alan Turing and His Intelligent Machine Utopia.Bernardo Gonçalves - 2023 - Philosophy and Technology 36 (3):1-31.
Turing made strong statements about the future of machines in society. This article asks how they can be interpreted to advance our understanding of Turing’s philosophy. His irony has been largely caricatured or minimized by historians, philosophers, scientists, and others. Turing is often portrayed as an irresponsible scientist, or associated with childlike manners and polite humor. While these representations of Turing have been widely disseminated, another image suggested by one of his contemporaries, that of a nonconformist, utopian, and radically progressive (...)

Galilean resonances: the role of experiment in Turing’s construction of machine intelligence.Bernardo Gonçalves - forthcoming - Annals of Science.
In 1950, Alan Turing proposed his iconic imitation game, calling it a ‘test’, an ‘experiment’, and the ‘the only really satisfactory support’ for his view that machines can think. Following Turing’s rhetoric, the ‘Turing test’ has been widely received as a kind of crucial experiment to determine machine intelligence. In later sources, however, Turing showed a milder attitude towards what he called his ‘imitation tests’. In 1948, Turing referred to the persuasive power of ‘the actual production of machines’ rather than (...)

New essays on the Fish-Dworkin debate.Thomas da Rosa de Bustamante & Margaret Martin (eds.) - 2023 - New York: Hart Publishing, An Imprint of Bloomsbury Publishing.
This book considers the seminal debate in jurisprudence between Ronald Dworkin and Stanley Fish. It looks at the exchange between Dworkin and Fish, initiated in the 1980s, and analyses the role the exchange has played in the development of contemporary theories of interpretation, legal reasoning, and the nature of law. The book encompasses 4 key themes of the debate between these authors: legal theory and its critical role, interpretation and critical constraints, pragmatism and interpretive communities, and some general implications of (...)

Benzodiazepines and antidepressants have been shown to change responses to unfairness; however, the effects of their combined use on unfairness evaluation are unknown. This study examines the effects of concomitant benzodiazepines and antidepressants long-term use on the evaluation of fair and unfair offers. To analyze behavioral changes on responses to unfairness, we compared the performance of medicated participants and healthy controls in the Ultimatum Game, both in the proposer and in the respondent role. The results showed that long-term psychotropic users (...)

Iowa Gambling Task (IGT) is one of the most widely used tools to assess economic decision-making. However, the research tradition on aging and the Iowa Gambling Task (IGT) has been mainly focused on the overall performance of older adults in relation to younger or clinical groups, remaining unclear whether older adults are capable of learning along the task. Argument Types and Fallacies in Legal Argumentation.Thomas Bustamante (ed.) - 2015 - Cham: Springer Verlag.
Strategic maneuvering refers to the efforts parties make to reconcile rhetorical effectiveness with dialectical standards of reasonableness. It manifests itself in topical selection, audience-directed framing and presentational devices. In analyzing strategic maneuvering one category of parameters to be considered are the constraints of the institutional context. In this paper I explore the institutional constraints for topical selection for the legal argumentative activity type insulting. I will make a distinction between statutory constraints, constraints developed in case law and constraints regarding language (...)

Jair Bolsonaro, the current President of Brazil, has made himself into one of the most influent advocates of COVID-19 denial. His health policy and his political doctrine are partly based on an implicit moral claim, which is neglected by contemporary political theory. Bolsonarism’s rhetoric raises a moral claim to freedom without responsibility, which relieves its followers from the burdens that emerge from liberal accounts of liberty or from basic goods accepted in a political community. In opposition to liberal or communitarian (...)

It deals with a number of general argument types and their particular use in legal argumentation. It provides detailed analyses of argument from authority, argument ad hominem, argument from ignorance, slippery slope argument and other general argument types. Each of these argument types can be used to construct arguments that are sound as well as arguments that are unsound. To evaluate an argument correctly (...)

On angels and human beings : Did Thomas Aquinas succeed in demonstrating the existence of angels?

I argue that Professor Gracia’s solution to the problem of personal identity, existence, and Professor Stump’s solution, form or the human soul, are not only compatible but also necessarily interdependent on one another. This argument rests on (1) the special nature of the human soul, and (2) the metaphysical claim that for Thomas the human soul and existence are inseparable. First, I refine (...)

Questions on the soul. [REVIEW]Bernardo Carlos Bazan - 1985 - Review of Metaphysics 38 (4):910-912.
As the basis for this translation, Robb has used the Latin text of the Quaestiones de anima which he edited in 1968. Since both the English version and the Latin text are responsibilities of the same scholar, should the former be judged by the quality of the latter? This approach does not seem fair, especially since Robb did not present his original text as a critical edition, but rather as a "corrected" edition, designed to serve students of medieval philosophy until (...)

The commemoration of the 700th anniversary of the canonization of Thomas Aquinas (1225-1274) as well as the fiftieth anniversary of the death of Jacques Maritain (1882-1973) present an opportunity to re-examine the neo-Thomism of the contemporary French philosopher. Our aim here will be to set out the philosophical argument from which Maritain establishes an inseparable link between human rights (i.e., the dignity of the human person) and natural law. We will thus seek to expose how Maritain supports democracy from (...)

It is well known that Aristotle’s Metaphysics presents historians with many problems of literary history. The fourteen books of "first philosophy" available today did not originally form one single work which Aristotle himself planned and authored. This work as we have it is rather the result of a compilation after its author’s death. His disciples have joined together different writings which reflect their master’s teaching at different points in his career. Consequently, historians are confronted with problems of chronology, both absolute (...)

This paper critically assesses Edmund Husserl's concept of the ‘life-world’, found in his Crisis of European Sciences and Transcendental Phenomenology. We argue that Husserl's phenomenology fails to consider the social and material arrangements that allow subjectivity to emerge in our shared world. We begin by outlining the concept as formulated in Husserl’s Crisis. We then entertain Husserl’s critique by his most famous student, Martin Heidegger. We suggest a reformulation of intersubjectivity, along the lines of Heidegger’s mitdasein, accounts for subjectivity as (...)
